1. Question
- This FY, SNFs will pay the remaining 2.3% back to CMS for the $1.7 billion overpayments that resulted from the transition from RUG-IV to PDPM in 2019. The "overpayments" were a result of SNFs changing the way the MDS questions were coded, resulting in higher PDPM scores in the Speech, Nursing and NTA components than initially predicted.
- SNFs are at risk of incurring a payment penalty in the amount of 2% of total Medicare Part A payments. The penalty occurs in 1 of 2 ways: Failing to submit at least 80% of all PPS Part A MDS assessments that are 100% complete (no dashes); AND/OR reporting all Vaccination Data (COVID and Influenza) to the National Healthcare Safety Network in the required timeframe. Non-compliance with either category will result in the penalty. The Final Rule adopted to increase the compliance rate from 80% to 90% in the new few years.
- The SNF Quality Reporting Program (SNF QRP) and SNF Value Based Purchasing Program (SNF VBP) both involve Medicare Part A residents only, and have had multiple new Measures added with this Final Rule.
- CMS has decided to return to the RUG-IV payment model in October, and do away with PDPM.

2. Question
- The Proposed Rule defined 3 new treatment codes (CPT Codes) for Caregiver Training Services. These codes will potentially allow PT, OT and Speech to provide family/caregiver training to occur without the resident present.
- Therapy professionals currently providing TELEHEALTH services in the SNF (and all other settings) have approval to continue through 12/31/24.
- The Final Rule extended the continuation of the temporary rule that was created during the PHE for "supervision of assistants via audio/visual technology." Through 12/31/24, Part B settings that require "direct" [in room] supervision of assistants (ie: Private Practice) will be able to meet this requirement "virtually." This does not directly impact the SNF setting, as Medicare Part A and Part B requirements call for "general supervision" of assistants, which does not required in room or on site supervision. Ultimately, the State Practice Act of each professional discipline will direct supervision requirements.
- Medicare Part B reimbursement rates will increase 4% on 1/1/24.

ALL the following statements about the updated MDS 3.0 changes that go into effect on 10/1/2023 are TRUE EXCEPT:
- All OBRA and PPS assessments contain multiple new items or data elements for 10/1/23. An updated RAI Manual has been released containing all new information. The last significant RAI Manual update was 2019.
- Once of the most significant updates to the MDS 3.0 is the removal of Section G – ADLs, from all Federally required assessments and the inclusion of Section GG – Functional Abilities on all OBRA assessments. Based on these MDS changes, Resource Utilization Group (RUG) scores (RUG-IV and/or RUG-III) can no longer be calculated.
- The MDS 3.0 update includes new "resident interviews" for race and ethnicity, that need to be conducted on all assessments.
- The observation period for Section GG will be Day 1, 2 and 3 for OBRA Admission Assessments, and the ARD plus the 2 previous days for all Quarterlies, Annuals and Significant Change Assessments. Section GG will also be required on the OBRA Discharge assessment.
- Due to the extended length of the new MDS 3.0 assessment, CMS approved completing only Annual assessments. Quarterly assessments are no longer required as part of the Paperwork Reduction Act.
